dev.fun Android Application

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and dev.fun ("Company," "we," "us," or "our") for the dev.fun mobile application ("App").

By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not download, install, or use the App.

1. License Grant

Subject to your compliance with this Agreement, dev.fun grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your compatible Android device solely for your personal, non-commercial use.

2. Restrictions

You agree NOT to:

Copy, modify, or create derivative works of the App

Reverse engineer, decompile, or disassemble the App

Remove, alter, or obscure any proprietary notices on the App

Use the App for any illegal or unauthorized purpose

Rent, lease, lend, sell, redistribute, or sublicense the App

Use the App in any manner that could damage, disable, or impair our servers or networks

Attempt to gain unauthorized access to any services, accounts, or networks

3. Ownership

The App and all intellectual property rights therein are and shall remain the exclusive property of dev.fun and its licensors. This Agreement does not grant you any ownership rights to the App.

4. User Content and Blockchain Transactions

You are solely responsible for all transactions, including token purchases and transfers, made through the App

All blockchain transactions are final and irreversible

dev.fun is not responsible for any losses resulting from your use of the App or blockchain transactions

You are responsible for maintaining the security of your wallet and private keys

5. Third-Party Services

The App may integrate with third-party services, including blockchain networks and external APIs. Your use of such services is subject to their respective terms and conditions. dev.fun is not responsible for third-party services.

6. Privacy

Your use of the App is subject to our Privacy Notice, available at https://docs.dev.fun/privacy-notice. By using the App, you consent to our collection and use of your information as described in the Privacy Notice.

7. Updates and Modifications

dev.fun may, at its sole discretion:

Update or modify the App at any time

Modify this Agreement at any time by posting the updated terms

Discontinue the App or any features without notice

Continued use of the App after modifications constitutes acceptance of the updated terms.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

dev.fun does not warrant that:

The App will be uninterrupted, secure, or error-free

Any defects will be corrected

The App is free of viruses or other harmful components

The results obtained from use of the App will be accurate or reliable

9. Limitation of Liability

To the maximum extent permitted by law, dev.fun shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to this Agreement or the App, whether in contract, tort, or otherwise, even if advised of the possibility of such damages.

In no event shall dev.fun's total liability exceed the amount you paid to dev.fun in the twelve (12) months preceding the claim, or one hundred US dollars ($100), whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless dev.fun and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use or misuse of the App

Your violation of this Agreement

Your violation of any rights of another party

Your blockchain transactions or wallet activities

11. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term. Upon termination:

You must cease all use of the App

You must uninstall and delete all copies of the App from your devices

Sections 4, 8, 9, 10, 12, and 13 shall survive termination

12. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Panama, without regard to its conflict of law provisions. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Panama.

13. General Provisions

Entire Agreement: This Agreement, together with our Privacy Notice, constitutes the entire agreement between you and dev.fun regarding the App.

Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver: No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

Assignment: You may not assign or transfer this Agreement. dev.fun may assign this Agreement without restriction.

14. Acknowledgment

By installing or using the App, you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms and conditions.
